Practice

Henry’s main area of practice is in Personal Injury litigation including RTA particularly fraudulent accident claims, bogus passenger, and LVI, along with cases falling into the new MOJ procedures. Disease claims including VWF, asbestosis and noise induced hearing loss, public and employers' liability actions are also regularly handled. He has a broad practice ranging from fast track to multi track and high court level claims. Henry also has a developing interest in clinical negligence claims including cases involving pain management syndromes and allegations of exaggeration of symptoms. Henry also regularly produces Schedules of Loss involving Ogden Table 6 disability claims and claims in excess of £100,000. In addition Henry has regularly appeared on behalf of families at inquests throughout the North West.

Henry regularly provides seminars and training days to solicitors on these and other areas of personal injury litigation.

Personal Injury cases of interest

Acting on behalf of the claimant in a claim investigating the incorrect application of a gastric band, pursuing both the surgeon and the producer of the band through product liability laws.

Successfully challenged Birmingham City Council’s general method of highway repair at appeal.

Disease Litigation cases of interest

Acting on behalf of a Claimant suffering from vibration syndrome in a claim against Network Rail where issues were raised in relation to limitation and causation of symptoms.

Involved in a case involving a victim of secondary exposure to asbestosis and considering the decision of Maguire v Harland & Wolff Plc [2005] EWCA Civ 1 and the state of knowledge at the time of the exposure.

Advising Defendants to in relation to their possible liability for noise induced hearing loss claims.

Clinical Negligence - cases of interest

Appearing as a Junior on a serious brain injury case listed for 2 weeks in the High Court where judgment was eventually entered for £2 million

A claim involving the mistreatment of a brain haemorrhage involving expert evidence from bio chemists as to the tests conducted.

Case involving a GPs allegedly negligent examination of a baby born with a dislocated hip.
 

Travel Law

Henry has a particular interest in travel law claims, including claims under the Package Travel Regulations, the Athens, Warsaw and Montreal Conventions, and at common law.

He has acted for both travel companies and Claimants on holiday. Henry regularly advises on holiday claims including the application of local standards evidence. Henry deals with workplace claims abroad especially accidents involving lorry drivers abroad.

Henry has been involved in claims involving accidents on aeroplanes and on board ships, including military vessels.

Issues that he commonly deals with include jurisdiction, service, limitation and choice of law and he is familiar with the interaction of the relevant international conventions and regulations.

Employment

Henry represents both Claimants and Respondents in the employment tribunal, including case management discussions, preliminary hearings and final merits and remedy hearings. Henry also drafts ET1 originating applications in addition to ET3 grounds of resistance. He deals with a variety of employment claims including those for unfair, constructive and wrongful dismissal and for unfair redundancy. He regularly appears in multi day Discrimination claims and has an interest in Equal Pay claims and TUPE proceedings.
