Inquest work
Iain has been instructed in numerous complex and high profile inquest cases. They include workplace fatalities and inquests in respect of deaths of members of the public.
Iain also has extensive experience of handling Article 2 Inquests arising out of deaths occurring in custody. His knowledge of the prison estate and the difficulties faced within the custodial system ensure his regular instructions in relation to these matters. Iain regularly acts for prisons and healthcare providers within this context.
Regulatory Work
HSE v R (Leeds Crown Court). Client charged with serious breaches of the HSWA 1974 following a fatal accident to one of its employees. Prosecution followed an extensive Police/HSE investigation and resulted in sentencing in the Crown Court.
Westminster City Council v G – Celebrity chef’s restaurant fined after failed inspection. Secured withdrawal of all proceedings against Managing Director of the business.
Environmental Agency
Ian has prosecuted and defended numerous Environmental Agency and Local Authority environmental prosecutions. They include:
Bury MBC v RTK Grab and Skip Hire Ltd – handling of waste and illegal dumping case.
Environment Agency v A Ltd – Successfully secured the withdrawal of 5 offences relating to the escape of highly toxic chemicals from client's site in North Wales. Allegations that 22 injured and significant potential for environmental harm all withdrawn.
EA v C Ltd – Iain defended a major house builder charged with 15 offences relating to the unlawful carriage and disposal of carcinogenic waste. Successfully persuaded the prosecution to withdraw 12 offences leaving 3 technical offences relating to paperwork to be accepted by the client.
