Siobhan acts for Claimant’s in Clinical Negligence cases and has experience of cases involving negligent birth and CP claims, delayed treatment, ophthalmology, surgery and drug overdose.
She has a niche Public Interest Immunity practice. She is frequently instructed by Local Authorities to deal with applications in the Crown Court for disclosure of sensitive material, usually but not exclusively, in child sex abuse cases. As independent counsel, she vets the material for relevance to issues raised in the criminal proceedings. She acted for Doncaster Metropolitan Borough Council in the PII proceedings concerning the 2 “Edlington” boys in both the Crown and the Family Courts.
She was initially second junior counsel then promoted to first junior counsel for the Claimant (with Gary Burrell QC and Graham Robinson – as they then were) in the case of Roe v Sheffield Light Railway Ltd and Sheffield City Council and others [2003] EWCA Civ 1: (2003) 2 WLR 848: (2004) QB 653, a test case arising out of road traffic accidents which lose control because of the presence of tram tracks in the highway. The multi-party litigation went to the Court of Appeal on a number of issues before resolving. Siobhan represented most of the other Claimants in the other actions once the stays were lifted after resolution of the Roe litigation.
